What changes on 12 August

A marketplace may request Spanish EPR information from sellers shipping to Spain. We prepare and coordinate the relevant private service; the registry, scheme and marketplace each make their own decisions.

Who is affected

Start with distance sellers outside the EU.

PPWR defines a producer by what it puts on a national market, not simply by where the company is incorporated. That pulls cross-border e-commerce into the registration system.

01 · ACT FIRST

Non-EU sellers shipping direct

US, UK, Swiss, Chinese and other third-country businesses selling packaged goods directly to Spanish end users can be the producer. Spain already requires an authorised representative for non-resident producers.

02 · CROSS-BORDER EU

EU sellers into another Member State

A business established in one Member State and selling direct to end users in another is also within PPWR's producer definition. Article 45(3) requires a local EPR representative under the regulation as adopted.

03 · VERIFY

Marketplaces and fulfilment providers

Platforms must collect registration information and a producer self-certification before allowing covered sellers to use their services. Fulfilment providers must make best efforts to verify the information.

What changes on 12 August

Registration evidence becomes part of marketplace checks.

PPWR does not reduce EPR to a recycling payment. It connects registration, financial responsibility and marketplace access.

Track weight by material across every channel. Reporting is simpler below 10 tonnes; registration is still mandatory.

Five steps to review the Spanish file under PPWR.

    Confirm producer status

    Map who sells, imports and ships each packaged product into Spain.

    Map the Spain representative route

    Identify the separately appointed Spain-established representative and the required written mandate.

    Prepare identifiers

    Obtain a Spanish NIF if needed and assemble company and packaging documents.

    Prepare registry + SCRAP steps

    Coordinate the producer-register and collective-scheme documents for independent review.

    Submit records and report

    Provide issued records for marketplace review and maintain the applicable annual material data.

Packaging compliance plans

Amazon Starter €399 first year, then €299/year. Standard €474/year.

Starter is limited to one company, packaging only, Amazon.es only, up to 500 kg/year and no historical regularisation. Standard has a €150 one-time setup. Scheme eco-contributions are separate and passed through at cost; a company NIF is €299 with an EPR dossier or €449 standalone.

Amazon sellers

Pay on Behalf pays a bill. It does not create your registration.

Amazon can calculate, report and pay eco-contributions for sales on its store, then recover those amounts and a service fee from your account. PPWR separately requires the producer to be registered—and tells marketplaces to collect that registration number.

That is the gap: continuing to sell under Pay on Behalf is not the same as owning a complete Spanish EPR file.

PPWR deadline questions

Is 12 August 2026 a new deadline for Spain?

It is the PPWR application date across the EU. Spain already requires packaging producers to register under Royal Decree 1055/2022, so businesses already in scope should not wait for August.

Does every small seller have to register?

PPWR Article 44 contains no general small-seller exemption from registration. Producers below 10 tonnes receive simplified annual reporting, but they still have to register before making covered packaging available.

I only sell through Amazon. Is Pay on Behalf enough?

It can handle eco-contribution reporting and payment for covered Amazon sales. It does not itself issue your ENV producer number or replace the separate national registration that PPWR tells marketplaces to verify.

What if the EU changes the authorised-representative rule?

A Commission proposal sought to suspend the rule for EU-established cross-border producers, but Council negotiations were discontinued in June 2026. The adopted PPWR text remains the basis for this page. For non-EU sellers, Spain’s national authorised-representative requirement already applies.

What documents should I start with?

Company extract, signatory ID and authority, Spanish NIF where required, product and packaging-material data, sales channels, and any existing producer or scheme references. We confirm the exact list during the free obligation check.
